1. Agreement to Terms
These Terms & Conditions (“Terms”) govern your access and use of the website, mobile
applications (if any), associated services, software, AI features, content, and tools provided by
Lenss (Pty) Limited (“Lenss”, “we”, “us”, “our”, “Company”).
By accessing or using the Lenss Platform you agree to be legally bound by these Terms.
If you do not agree with these Terms, you must immediately stop using the Platform.
2. Definitions
“Platform” means the Lenss website, mobile apps, APIs, tools, and services.
“User”, “you”, “your” means anyone accessing or using the Platform.
“AI Services” means any artificial intelligence, machine learning, automation, or
algorithm-driven recommendations, outputs, or predictions provided by the Platform.
3. Eligibility & Account Registration
3.1 Users must be 13 years or older to use the Platform.
3.2 If you are under 18, you must have parent/guardian consent to register and use the
Platform.
3.3 You must provide accurate and complete information when creating an account.
3.4 You agree to safeguard your login credentials and notify us of any unauthorized access.
4. Services Overview
Lenss provides AI-assisted:
● Career guidance and recommendations
● Skills assessment and profiling
● Progress tracking and reporting
● Learning pathway insights
● Analytics dashboards and related services
These services are informational, guidance-oriented, and predictive only — not guarantees
of outcomes.
5. User Obligations
You agree not to:
● Use the Platform to upload or share illegal, harmful, fraudulent, or offensive content
● Reverse engineer, copy, reproduce, or extract Lenss’s code, models, or algorithms
● Bypass access protocols, security measures, or controls
● Use the Platform in any manner that violated South African law, including POPIA
You must promptly update your account information if it changes.
6. AI Outputs & Disclaimers
6.1 Lenss uses AI to generate insights, suggestions, and predictions. These outputs are:
● Based on your provided data
● Not deterministic
● Subject to change with improved models or data
6.2 No Guarantee of Accuracy:
AI predictions are probabilistic; they do not guarantee job placements, academic admission,
income level, or career achievements.
6.3 You acknowledge that AI systems may have limitations, including bias and imperfect
predictions.
7. Content Ownership & Rights
7.1 All Platform content text, code, design, data structures, and proprietary tools is owned by
Lenss or its licensors.
7.2 By using the Platform, you grant Lenss a non-exclusive, worldwide, royalty-free license to
use, host, store, and process the information you provide for service delivery.
8. License & Restrictions
You are granted a limited, non-exclusive, non-transferable, revocable license to use the
Platform.
You may not:
● Sell, sublicense, or redistribute the Platform
● Access the Platform to build a competing service
● Scrape, mine, or collect data via automated tools
9. Fees & Payments
If any part of the Platform is payable:
9.1 You agree to the pricing, billing frequency, and payment method displayed during purchase.
9.2 All payments are non-refundable unless otherwise stated.
10. Confidentiality & Security
10.1 We implement reasonable technical and organisational measures to protect your data.
10.2 You agree not to circumvent security restrictions or access data beyond your authorization.
11. Breach & Termination
11.1 We may suspend or terminate access at any time for:
● Violations of these Terms
● Fraudulent or abusive behavior
● Requests by law enforcement
11.2 You may cancel your account at any time.
11.3 Upon termination, all rights granted to you will cease.
12. Warranties and Liability
12.1 No Warranty: The Platform is provided “as is” and “as available”.
12.2 Limitation of Liability: To the fullest extent permitted by law, Lenss (Pty) Limited is not
liable for:
● Direct, indirect, or consequential loss
● Data loss or system failures
● User decisions based on AI outputs
12.3 Indemnity: You agree to indemnify Lenss against third-party claims arising from misuse of
the Platform.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of South Africa.
Disputes will be resolved in courts competent in South Africa.
14. Amendments
We may revise these Terms at any time. Continued use after changes means you accept them.
We will provide reasonable notice for material changes.
